Comunicaciones (MTC) de Per\u00fa; el 28 de abril se realiz\u00f3 el webinar de Capacitaci\u00f3n sobre las Implicancias de la Entrada en Vigor del \u00abConvenio de las Naciones Unidas sobre el Transporte Mar\u00edtimo de Mercanc\u00edas, 1978\u00bb (Reglas de Hamburgo. El evento fue organizado por el MTC de Per\u00fa.<\/p><p>En la oportunidad se trataron temas de alto inter\u00e9s como el tr\u00e1mite legislativo llevado a cabo por Per\u00fa durante el proceso de denuncia de las Reglas de la Haya, \u00faltimas que conformaban la anterior reglamentaci\u00f3n del tr\u00e1nsito mar\u00edtimo previo a la ratificaci\u00f3n e implementaci\u00f3n de las Reglas de Hamburgo, las que comenzaron a ser aplicadas desde el 1 de abril.<\/p><p>En la oportunidad Katerina Vuskovic indic\u00f3 que se deb\u00eda aprovechar la oportunidad para actualizar el sistema de derecho mar\u00edtimo del Libro III. Puntualiz\u00f3 adem\u00e1s que \u00abtenemos que ver la experiencia de los pa\u00edses que mantienen en vigor de las Reglas de Hamburgo como Rep\u00fablica Dominicana, Paraguay, pero particularmente el caso de Chile\u00bb.<\/p><p>Por su parte Jos\u00e9 Vicente Guzm\u00e1n, de Guzm\u00e1n Escobar &amp; Asociados de Colombia, realiz\u00f3 un completo an\u00e1lisis de las principales diferencias entre las Reglas de la Haya y las de Hamburgo. Se\u00f1al\u00f3 que \u00abeste puede ser un paso intermedio para una futura incorporaci\u00f3n de las Reglas de R\u00f3terdam que son el estatuto m\u00e1s moderno que regula el transporte mar\u00edtimo actualmente\u00bb. A\u00f1adi\u00f3 que \u00absiguiendo el ejemplo de Chile tambi\u00e9n es posible incorporarlas en la regulaci\u00f3n interna antes de su vigencia internacional\u00bb.<\/p><p>En tanto, Miriam Sara Repetto, de Brezza Legal de Per\u00fa, se refiri\u00f3 al proceso de incorporaci\u00f3n de las Reglas de Hamburgo. Entre ellos destac\u00f3 que actualmente el transporte es un contrato consensual y que ya no es necesario acreditarlo con un conocimiento de embarque, sino que basta un mail, booking o la reserva de espacio. Sobre el concepto de porteador precis\u00f3 que \u00abmuchas veces un freight forwarder o NVOCC ser\u00e1 considerado porteador, pero hay que analizar caso a caso y estudiar si se comprometi\u00f3 el traslado o transporte de la carga, si es as\u00ed, ser\u00e1 porteador legalmente y responder\u00e1 por el per\u00edodo acordado, usualmente indicado en un bill of lading emitido por ese mismo forwarder o NVOCC\u00bb.<\/p><p>Destac\u00f3 adem\u00e1s que la experiencia chilena ha sido exitosa por la conjunci\u00f3n de varios factores como la modernizaci\u00f3n, en 1988, de todo el Libro III del C\u00f3digo de Comercio y antes, en 1978, mediante una nueva ley de navegaci\u00f3n, la incorporaci\u00f3n de las Reglas de Hamburgo y el arbitraje como f\u00f3rmula de soluci\u00f3n de controversias.<\/p><p>\u00c1ngel Ramos, de Ramos Brusiloff de Rep\u00fablica Dominicana, expuso sobre la experiencia en su pa\u00eds y realiz\u00f3 un muy acotado resumen de los principales aspectos que valora como la responsabilidad por custodia explicitada en las Reglas de Hamburgo, adem\u00e1s de diversos aspectos sobre la responsabilidad, entre otros.<\/p><p>La jornada finaliz\u00f3 con la
